CUSTOMER UPGRADE PROGRAMME TERMS AND CONDITIONS

  1. TERMS & CONDITIONS
  • These are the terms and conditions (“Terms and Conditions”) which apply to ghd’s Upgrade Programme (the “Upgrade Programme”). You will have the option to participate in the Upgrade Programme by trading in your old ghd straightener (“Old Straightener”) and purchasing a ghd Chronos hair straightener in black or white, or ghd Chronos Max hair straightener in black (“New Straightener”) from ghdhair.com/za (our “Website”) or any of our participating salons. In return for trading in your Old Straightener when purchasing a New Straightener, you will be eligible for a refund of R1 500.00 (one thousand five hundred Rand) on your purchase if made online, or a discount of R1 500.00 (one thousand five hundred Rand), inclusive of VAT, on your purchase if made in-store at a participating salon.   • The Upgrade Programme does NOT apply to the purchase of a ghd Chronos hair straightener in any colour other than black or white, or a ghd Chronos Max hair straightener in any colour other than black, the ghd Chronos Hair Straightener limited edition, gift set or bundle. Please read these Terms and Conditions carefully to find out further details about how the Upgrade Programme works. BY PARTICIPATING IN THE UPGRADE PROGRAMME, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THESE TERMS AND CONDITIONS AND AGREE TO BE BOUND BY THEM.
  • The Upgrade Programme is run by Good Hair Day South Africa Proprietary Limited (Registration Number: 2004/021262/07), trading as ghd, with P.O. Box 818, Gillitts (hereinafter referred to as “ghd”, “we” or “us”). If you wish to contact us about the Upgrade Programme, you can email customerservice@ghdhair.co.za, phone 0860 109 366 or contact our customer care team through https://help.ghdhair.com/hc/en-za/requests/new.
  • The Upgrade Programme is a short-term promotional offer which will be available from 10:00 on 1 September 2025 until 10:00 on 30 September 2025 (or an earlier date in the event that stock of the New Straighteners becomes unavailable) (the “Promotion Period”). The Upgrade Programme is open to residents of the Republic of South Africa only, and you must be over the age of eighteen (18) to participate.
  • Only old devices, which are electrical hair straighteners manufactured by ghd may be traded in as part of the Upgrade Programme. The Upgrade Programme only applies when you buy a ghd Chronos hair straightener, in the colour black or white, or a ghd Chronos Max hair straightener, in the colour black, and is subject to the product availability on our website (ghdhair.com/za) for online purchases, and in the relevant participating salon for in-store purchases.
  • The promotional offer is limited to one (1) purchase of a New Straightener, after which any additional purchases under the Upgrade Programme may be rejected at our sole discretion. We may also refuse to accept and cancel any orders placed under the Upgrade Programme where we have reasonable grounds to suspect fraudulent activity.
  • Only New Straighteners purchased at full price are eligible for the Upgrade Programme. The Upgrade Programme cannot be used in conjunction with any other offer or promotion (including, but not limited to, spring sale or promotional vouchers).
  • We reserve the right to amend, postpone or suspend the Upgrade Programme at any time, if circumstances beyond our reasonable control prevent us from continuing with the Upgrade Programme. In such an event, to the extent permitted by law, ghd and the participating salons shall have no liability whatsoever arising from the amendment, postponement or suspension of the Upgrade Programme.

  1. THE UPGRADE PROGRAMME – HOW IT WORKS

VIA OUR WEBSITE

  • To participate in the Upgrade Programme via our Website, you should –
  • Add a full price ghd Chronos hair straightener, in the colour black or white, or ghd Chronos Max hair straightener, in the colour black, to your basket;
  • Enter the code “UPGRADE” at checkout to notify us that you want to trade in your old straightener to take part in the Upgrade Programme; and
  • Send us your old ghd straightener within five (5) working days of receiving your new straightener.
  • When you complete your purchase, please be aware that the new straightener will be purchased at full price. You can purchase your new straightener using any of the payment methods available on our Website.
  • To arrange the collection of your Old Straightener, send an email to customerservice@ghdhair.co.za with “Upgrade” in the subject line, and in the email body, please include your order number, model of styler to be collected and the collection address. An agent will contact you to arrange collection.
  • Upon collection, please hand over your Old Straightener, packaged in the Skynet flyer found in your delivery box, along with the completed leaflet, to the Skynet driver and retain proof of collection either in the form of an electronic or a physical waybill. We do not accept any responsibility or liability for loss, damage or delays that may occur before we receive the Old Straightener.
  • Shipping fees to collect your Old Straightener will be covered by ghd provided the collection has been arranged with us through our customer service and collected by our appointed service provider, Skynet. Any shipping or delivery fees incurred by you, should you on your own accord send your Old Straightener to us will not be refunded in any event.
  • Once we have received your Old Straightener back from you, we will check that it is eligible for participation in the Upgrade Programme and that the relevant criteria set out in clause 3 below (the “Eligibility Criteria”) have been met. We will notify you in writing within five (5) working days of confirming receipt of your Old Straightener whether it meets the Eligibility Criteria.
  • Once it has been verified that the Eligibility Criteria has been met, and you have been notified accordingly, we will issue a partial refund of R1 500.00 (one thousand five hundred Rand) via your original payment method for the New Straightener within five (5) working days of notifying you. The refund will be issued by a representative of ghd and will apply to the purchase of the New Straightener made as part of the Upgrade Programme.
  • Once your partial refund has been issued, please allow at least three (3) to five (5) working days for the funds to reach your account, although note this may differ from bank to bank. We will issue written confirmation to you once your refund has been processed.
  • The Upgrade Programme code can only be used once per order, meaning the maximum price reduction per New Straightener is R1 500.00 (one thousand five hundred Rand).
  • ghd’ s Standard Terms and Conditions of Sale (which can be found here) will apply to the purchase of your New Straightener, except where the ghd’ s Standard Terms and Conditions of Sale are amended by these Terms and Conditions or conflict with these Terms and Conditions, then these Terms and Conditions will apply. These Terms and Conditions do not apply to normal purchases made from our Website.

 IN-SALON

  • You can also take part in the Upgrade Programme by going to a participating salon in person. In order to participate in the Upgrade Programme through a participating salon, approach the salon and hand in your Old Straightener to the salon and you will receive the discount off your New Straightener at the point of sale.
  • Your Old Straightener must meet the Eligibility Criteria, as set out in clause 3 below, in order to qualify, and the salon will check this before issuing a discount on your New Straightener. They will arrange for your Old Straightener to be sent back to us directly.
  • If your Old Straightener meets the Eligibility Criteria, the discount on the purchase of your New Straightener will be granted by a sales representative at the participating salon where the purchase is made and will be applied at the time of purchase.
  • The purchase of your New Straightener from the salon will be governed by the contract of sale between you and the salon directly, and not ghd. Please refer to the salon’s terms and conditions and returns policy in-store.

  1. YOUR OLD STRAIGHTENER
  • Once we have received your Old Straightener, you acknowledge that it becomes ghd’s property, and we will be unable to return it to you. This applies whether or not your Old Straightener meets the Eligibility Criteria below, and even if you change your mind about participating in the Upgrade Programme.
  • The following criteria (“Eligibility Criteria”) will apply in order to qualify for the partial refund (in respect of an online purchase) or a discount (in respect of an in-salon purchase) on your New Straightener under the Upgrade Programme:
  • Your old Straightener must be a genuine ghd straightener (any model). Other brands will not be accepted, and if we suspect that the old straightener is a counterfeit product we reserve the right to reject it and involve enforcement agencies if we deem it necessary to do so; other ghd products, such as hair dryers, wetline products, brushes and accessories, are NOT ELIGIBLE for the Upgrade Programme; and your Old Straightener does not need to be in working order, but it must be in one piece with its cord and plug still attached.
  • If you fail to send us your Old Straightener within five (5) days of receiving the New Straightener, or if upon inspection your Old Straightener is not an eligible product or does not meet the above Eligibility Criteria, you will not be able to participate in the Upgrade Programme and we reserve the right not to issue, or to cancel, the partial refund against the purchase of your New Straightener. If in these circumstances you wish to return the New Straightener to us, you may do so in accordance with our standard returns policy.
  • When you return your Old Straightener to us, we work with a trusted waste disposal partner to ensure these tools are disposed of responsibly. 

 

  1. YOUR RIGHTS
  • If you change your mind about the purchase of your New Straightener via our Website, you are entitled to cancel your order and return it in accordance with our returns policy, which can be found on our Website. Any refund you receive will be the purchase price less the partial refund already issued to you under the Upgrade Programme.
  • Participating in the Upgrade Programme does not affect your statutory rights, including but not limited to your rights under the Consumer Protection Act, 68 of 2008, in respect of defective goods and the Electronic Communications and Transactions Act, 25 of 2002, in respect of the cancellation of any transaction related to the supply of goods.

 

  1. DATA PRIVACY
  • We will use the personal information you provide to us in accordance with our privacy notice, which you can find here. YOU AGREE THAT YOU HAVE READ AND UNDERSTOOD THE PRIVACY NOTICE BY PARTICIPATING IN THE UPGRADE PROGRAMME AND EXPRESSLY CONSENT TO OUR COLLECTION, USE AND PROCESSING OF YOUR PERSONAL INFORMATION FOR THE PURPOSES OF ADMINISTERING THE UPGRADE PROGRAMME.
  • For details of how participating salons may use your personal information, please speak to them directly. WE WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY CLAIM, LOSS, OR DAMAGE ARISING OUT OF OR IN CONNECTION WITH THE USE OR PROCESSING OF YOUR PERSONAL INFORMATION BY ANY PARTICIPATING SALON.

 

  1. LIMITATION OF LIABILITY
  • GHD WILL NOT BE LIABLE FOR ANY FAILURE TO COMPLY WITH ITS OBLIGATIONS UNDER THESE TERMS AND CONDITIONS WHERE SUCH FAILURE IS DUE TO EVENTS BEYOND ITS REASONABLE CONTROL, INCLUDING BUT NOT LIMITED TO, WAR, CIVIL UNREST, FIRE, FLOOD, STORM, EARTHQUAKE, STRIKE, LOCKOUT, LABOUR DISPUTE, SABOTAGE, EXPLOSION, ACT OF GOD OR ANY LAW, REGULATION, ORDER OR OTHER ACT OF ANY GOVERNMENT OR AUTHORITY.
  • GHD WILL NOT BE LIABLE FOR YOUR FAILURE TO SUCCESSFULLY PARTICIPATE IN THE UPGRADE PROGRAMME FOR WHATEVER REASON, HOWSOEVER ARISING, INCLUDING BUT NOT LIMITED TO ANY TECHNICAL OR NETWORK ISSUES, SYSTEM ERRORS OR DELAYS, FAILURES OR LOSSES ARISING FROM POSTAL OR DELIVERY SERVICES, OR ANY ACT, OMISSION OR ERROR BY A PARTICIPATING SALON.
  • IN NO EVENT WILL GHD BE LIABLE FOR ANY INDIRECT OR CONSEQUENTIAL LOSS ARISING FROM OR IN CONNECTION WITH THE UPGRADE PROGRAMME.

 

  1. OTHER IMPORTANT TERMS
  • We may transfer our rights and obligations under these Terms and Conditions to another organisation. You may only transfer your rights or your obligations under these Terms and Conditions to another person if we agree in writing. 
  • This contract is between you and ghd. No other person shall have any rights to enforce any of its terms.
  • Each of the paragraphs of these Terms and Conditions operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining terms will remain in full force and effect.
  • These Terms and Conditions constitute the entire agreement between you and ghd regarding the Upgrade Programme.
  • If we fail to insist that you perform any of your obligations under these Terms and Conditions, if we do not enforce our rights against you or if we delay in doing so, that will not mean that you do not have to do those things, and it will not prevent us from taking steps against you at a later date nor will it prevent us from exercising any of our rights in accordance with these Terms and Conditions.  For example, if you do not pay and we do not request payment but deliver the new straightener to you, we can still require you to make a payment at a later date. 
  • These Terms and Conditions are governed by and will be interpreted in accordance with the laws of the Republic of South Africa. You and ghd agree to submit to the non-exclusive jurisdiction of the South African courts.
