MONTHLY PRODUCT REVIEW PRIZE DRAW – TERMS AND CONDITIONS

Introduction
1. This document sets out the terms and conditions (“Terms”) that apply to participating in ghd’s monthly Product Review Prize Draw (“Promotion”).
2. The Promotion is managed by Jemella Australia Pty Limited ACN 104 455 138, a company incorporated in Australia , with its registered office at Level 24, 167 Eagle Street, Brisbane QLD 4000, Australia, (collectively, “ghd ” or “we/us/our”). ghd may be contacted at the above address. If you are a New Zealand resident, you can contact us in New Zealand at Private bag 211030, Laurence Stevens Drive, Auckland, 2154 ., (the “Promoter”).
3. By entering this Promotion all entrants will be deemed to have accepted and agreed to be bound by these Terms.
Eligibility and how to enter
1. The Promotion is open to all Australian and New Zealand residents aged 18 or over, except employees of the Promoter, their families, agents or any third party associated with administration of the prize draw.
2. The Promotion will run from the 13th of each month to 23:59 on the last day of that month (each, a “Promotion Period”). Any entries posted outside the Promotion Period will not be eligible for that month’s draw.
3. Entrants can enter the Promotion, as follows:
  1. When customers place an online order for a ghd product (“Product”) on https://www.ghdhair.com/au/ (the “Site”), they will be sent an email via our reviews partner, BazaarVoice , inviting them to complete a review of their Product (“Product Review ”).
  2. All Product Reviews which are verified by BazaarVoice, genuine , relate to an actual Product purchase, and are posted on the Site during the Promotion Period in accordance with our Terms of Use (https://www.ghdhair.com/au/terms-and-conditions ) will be entered into the draw for the Promotion Period in which their Product Review was posted.
  3. Product Reviews should reflect the entrant’s honest opinion of the relevant Product. Providing a negative review will not affect an entrant’s chance to win the Prize (as defined below).
  4. Product Reviews relating to orders for Products which have been returned or refunded for any reason will no longer be valid for entry into the Promotion .
  5. A Winner will be selected in each month of the Promotion Period, as further set out in clause 3. The cut-off date for an entry to be valid to for that months’ Promotion will be as set out in clause 2.2.
4. Each Product Review posted during the Promotion Period will count as a separate entry, for the month in which it is posted. For the avoidance of doubt, a Product Review will only count as a separate entry where it relates to a separate Product purchase, and satisfies the other requirements set out under clause 2.3.
5. All Product Reviews will be subject to the Terms of Use (https://www.ghdhair.com/au/terms-and-conditions), and any further terms and conditions provided by our ratings and review partner, BazaarVoice .
6. Entrants may not enter or upload in their Product Review any content which: contains any third party’s trade marks or intellectual property rights; infringes upon any third party’s rights; or is offensive, pornographic, illegal or unlawful. By entering this Promotion, the entrant agrees to indemnify the Promoter against any third party claims for copyright infringement that relate to the Product Review by the entrant.
7. Entries containing any commercial logos, web addresses and any other commercial content will not be considered eligible.
8. The Promoter may disqualify any entry without notice or explanation if it contains anything that the Promoter regards, in its sole discretion, to be offensive or obscene in any way or to not be in compliance with these Terms.
Winner selection and prizes
1. One (1) winning entry (the “Winner”) will be selected from all valid entries for each Promotion Period. Selection of the Winner will be at random and performed by a computer process on the 1^st (or the closest Monday) of the month following a particular Promotion Period.
2. Each Winner shall receive a free ghd travel pack including a flight+ hair dryer PLUS a collection of our brushes & wetline (the “Prize”) which has an approximate value of [NZD $579].
4. The Promoter will contact the Winner via email to the address associated with the winning Product Review within seven (7) days of the Winner being selected with instructions of how to claim the Prize. If a Winner does not respond to the Promoter within seven (7) days of being notified by the Promoter, then the Winner's Prize will be forfeited and the Promoter will be entitled to select another winner in accordance with the process described above.
5. The Winner will be deemed to have forfeited the Prize if the Winner is found to be ineligible or otherwise not in compliance with these Terms. In the event the Winner is deemed to have forfeited the Prize, a new winner will be selected in accordance with the process described under clause 3.3.
6. Each Winner will receive their Prize within 28 days of claiming it.
7. The Prize is non-transferable, non-negotiable and non-refundable, and there is no cash alternative. The Promoter reserves the right to substitute any Prize with a prize of equivalent or higher value if circumstances outside of its reasonable control makes it necessary to do so.
8. Prizes are for personal use only.
10. If either party to these terms has a dispute regarding the Promotion, or arising as a result of a breach of either party’s rights or obligations under these Terms and Conditions, the parties agree to:
11. 1. promptly notify the other of their dispute, and the particulars of the dispute, in writing to the other; and
  2. attempt in good faith to resolve the dispute within 28 days of the written particulars being given, or any longer period agreed to in writing by the parties.
Privacy and publicity
1. As a result of an entrant’s participation in the Promotion the Promoter will collect certain personal information relating to entrants and potential Winners (including where relevant, photographic or other personal identification in order to verify the identity of entrants and/or Winners). The information will be processed in accordance with the Promoter’s Privacy Notice at https://www.ghdhair.com/nz/terms-and-conditions/privacy-policy . By entering into the Promotion (and/or accepting the Prize if you are a Winner), entrants consent to such processing and confirm that all data provided by them is truthful and accurate.
2. To facilitate BazaarVoice inviting entrants to complete Product Reviews, and their verification of entrant’s Product Reviews in accordance with clause 2.3, we will share certain personal information (including nickname, location, email, age, gender, hair length and hair type), with BazaarVoice.
3. By choosing to not provide us with the personal information required under clause 4.1, customers will not be able to enter the Promotion.
4. The Promoter must retain and may be required to share personal information regarding entrants with relevant authorities in order to meet its record keeping obligations.
5. Entrants acknowledge that the Promoter may be required to either publish or make available information that indicates that a valid award took place. Entrants agree that should they win, the Promoter may publish the first initial of their first name, their last name and postcode.
6. Entrants agree to participate in such reasonable promotional activities as the Promoter may request.
Intellectual Property
1. All entries submitted must be the personal opinion and original work of the entrant submitting them, who must be the copyright holder. Each entrant agrees that they have the permission of any third parties appearing in any content submitted.
2. By entering the Promotion each entrant grants to the Promoter (and its affiliated companies), a transferable, non-exclusive, worldwide, irrevocable, perpetual, royalty-free, unlimited licence to use and reproduce the content, video footage and/or photographs uploaded by the entrant to enter this Promotion for publicity and advertising purposes in any and all media (including but not limited to Instagram and Facebook) without additional notification, permission or consideration to the entrant, whether or not the entry is selected as the winning entry, as further set out in the Promoter’s Terms of Use (https://www.ghdhair.com/nz/terms-and-conditions/terms-of-use).
General
1. The decision of the Promoter regarding any aspect of the Promotion is final and binding and no correspondence will be entered into.
2. The Promoter reserves the right to hold void, cancel, suspend, or amend the Promotion at any time where it deems necessary to do so.
3. For entrants that are resident in Australia, these Terms are governed by Australian law and entrants to the Promotion submit to the jurisdiction of the Australian courts. For entrants that are resident in New Zealand, the Promotion, these Terms and Conditions, and any disputes arising in relation to an either party’s rights under these Terms and Conditions, will be governed exclusively by the laws of New Zealand.
4. The Promoter will not be liable for any damages, injury, costs or expenses suffered or incurred by entrants in relation to participation in the Promotion and/or the use of any Prizes except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
5. The Promoter accepts no responsibility for entries not successfully completed or posted for any reason including due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind. If for any reason a technical interruption, fault or site failure occurs, the Promotor does not take any responsibility for incomplete entries or entries not received for any reason.
